serveyou.ai LLC Acceptable Use Policy

This acceptable use policy covers the products, services, and technologies (collectively referred to as the "Products") provided by serveyou.ai LLC under any ongoing agreement. It's designed to protect us, our customers and the general Internet community from unethical, irresponsible and illegal activity.

serveyou.ai LLC customers found engaging in activities prohibited by this acceptable use policy can be liable for service suspension and account termination. In extreme cases, we may be legally obliged to report such customers to the relevant authorities.

Fair use

We provide our facilities with the assumption your use will be "business as usual", as per our offer schedule. If your use is considered to be excessive, then additional fees may be charged or capacity may be restricted.

We are opposed to all forms of abuse, discrimination, rights infringement and/or any action that harms or disadvantages any group, individual or resource. We expect our customers and, where applicable, their users ("end-users") to likewise engage our Products with similar intent.

Customer accountability

We regard our customers as being responsible for their own actions as well as for the actions of anyone using our Products with the customer's permission, including actions taken by AI agents created, configured, or deployed by the customer. This responsibility also applies to anyone using our Products on an unauthorized basis as a result of the customer's failure to put in place reasonable security measures.

By accepting Products from us, our customers agree to ensure adherence to this policy on behalf of anyone using the Products as their end users, and on behalf of any AI agents or automated systems operating under their account. Complaints regarding the actions of customers, their end-users, or their AI agents will be forwarded to the nominated contact for the account in question.

If a customer — or their end-user, AI agent, or anyone using our Products as a result of the customer — violates our acceptable use policy, we reserve the right to terminate any Products associated with the offending account or the account itself or take any remedial or preventative action we deem appropriate without notice. To the extent permitted by law, no credit will be available for interruptions of service resulting from any violation of our acceptable use policy.

Communications and Consent Requirements

Users of serveyou.ai LLC's services are responsible for ensuring that all communications, including text messages, voice calls, emails, and chat messages, sent through our platform — whether sent manually, through automated workflows, or through AI agents — comply with applicable US laws and regulations. This includes obtaining proper consent from recipients, respecting opt-out requests, and adhering to content restrictions.

Consent for Text Messages

For text message communications, users must obtain prior express written consent from recipients as required by the Telephone Consumer Protection Act (TCPA). Consent must be clear and conspicuous, and users must maintain records of consent, such as signed forms or electronic opt-in confirmations.

A2P Registration

All users who deploy SMS or voice communications through the Platform must complete Application-to-Person (A2P) 10-Digit Long Code (10DLC) campaign registration and receive carrier approval before sending any SMS messages. Users must not deploy SMS agents or automated SMS communications until their A2P registration has been approved. Failure to complete A2P registration before deploying SMS communications is a violation of this Acceptable Use Policy and may result in immediate suspension of SMS capabilities and account termination.

Consent for Emails

For email communications, users must obtain express consent from recipients in compliance with the CAN-SPAM Act. This includes providing a clear and conspicuous explanation of how the recipient can opt out of future emails and honoring opt-out requests promptly.

AI-Initiated Communications

Communications sent by AI agents are treated as communications sent by the customer who created or deployed the AI agent. Customers are fully responsible for ensuring that AI-initiated communications comply with all applicable laws and regulations, including consent requirements, opt-out mechanisms, sender identification, and content restrictions. The use of AI agents does not relieve the customer of any legal obligations regarding communications.

Record Keeping

Users are responsible for maintaining records of consent for all communications, including communications initiated by AI agents. These records must be made available to serveyou.ai LLC upon request for verification purposes.

Opt-Out Mechanisms

serveyou.ai LLC provides built-in opt-out controls for SMS communications sent through the Platform, including automatic processing of "STOP" replies. These controls are developed and maintained by serveyou.ai LLC. Users are responsible for ensuring that they respect and honor any opt-out requests received from recipients, including through any additional channels. Once a recipient opts out, users must cease sending further communications to that recipient, including through AI agents. Users are solely responsible for obtaining initial consent from their End-Users before initiating communications; the availability of built-in opt-out controls does not relieve users of their consent collection obligations.

Legal Compliance

Users must ensure that all communications comply with applicable US laws and regulations, including but not limited to the TCPA, CAN-SPAM Act, and any other relevant federal or state laws. This includes prohibitions on sending illegal, harmful, or unsolicited content, such as spam, fraudulent messages, or content that infringes on the rights of others.

Sender Identification

Users must clearly identify themselves as the sender in all communications, including communications sent by AI agents. For text messages, this means including the user's name or business name in the message. For emails, users must include a valid physical postal address and a clear way for recipients to opt out of future communications. AI-generated communications must not misrepresent the sender's identity or create the false impression that they are from a human when they are from an AI agent, to the extent required by applicable law.

Prohibited Content

Users are prohibited from sending any content that is illegal, harmful, unwanted, or otherwise violates serveyou.ai LLC's Acceptable Use Policy. This includes, but is not limited to, content related to illegal gambling, narcotics trafficking, or any activity that poses a threat to public safety or individual rights. AI-generated content must not promote bias, discrimination, or hallucinations leading to non-compliant messages (e.g., under CA Unruh Act).

AI Agent and Automation Specific Rules

Prohibited AI Agent Uses

You must not create, configure, or deploy AI agents or automated systems that:

• Operate without appropriate human oversight, monitoring, or the ability to be immediately deactivated;
• Impersonate real individuals without their explicit, documented consent;
• Generate or distribute deepfakes, synthetic media designed to deceive, or fraudulent content;
• Engage in social engineering, phishing, or other manipulative practices;
• Collect personal information from minors without verifiable parental consent as required by COPPA and applicable state laws;
• Make automated decisions that have legal or similarly significant effects on individuals (such as credit decisions, employment decisions, or housing decisions) without appropriate human review and applicable legal compliance;
• Circumvent or attempt to circumvent rate limits, resource quotas, content filters, or other safety measures implemented by the Platform;
• Engage in recursive or looping operations without appropriate termination conditions, resource limits, and monitoring;
• Access, process, or store data belonging to other Platform Users or their End-Users;
• Violate the terms of service or acceptable use policies of any third-party service accessed through the Platform, including but not limited to xAI, Anthropic, Google, Twilio, Stripe, and any Third-Party Integrations connected by the Platform User; or
• Engage in any activity that would violate applicable AI regulations, including California AB 853 (AI Transparency Act) and any other state or federal AI laws.

Resource Abuse

AI agents and automated systems must be configured with appropriate resource limits and termination conditions. Recursive or looping agents must include safeguards to prevent runaway resource consumption. We reserve the right to immediately suspend or terminate any AI agent or automated system that, in our sole discretion, poses a risk to Platform stability, security, or performance, or that consumes excessive resources relative to your subscription tier.

Monitoring and Logging

You must maintain adequate logs of AI agent activity to support investigation of any issues, complaints, or suspected policy violations. serveyou.ai LLC may require access to such logs in connection with investigating reported violations of this policy or applicable law.

Deployed Application Specific Rules

Security Requirements

All Deployed Applications must meet minimum security standards, including but not limited to:

• Implementing appropriate authentication and authorization mechanisms for any application that handles user accounts or sensitive data;
• Protecting against common web application vulnerabilities, including but not limited to those identified in the OWASP Top 10;
• Encrypting sensitive data in transit (using TLS/HTTPS) and at rest;
• Implementing appropriate input validation and output encoding to prevent injection attacks;
• Conducting reasonable security testing and code review prior to deployment, particularly for AI-generated code;
• Promptly patching or remediating any security vulnerabilities discovered after deployment; and
• Implementing appropriate logging and monitoring to detect security incidents.

serveyou.ai LLC provides security tools and features to assist with these requirements but does not guarantee, audit, or certify the security of Deployed Applications. Failure to maintain adequate security may result in suspension or termination of your account.

Prohibited Application Types

You may not deploy applications that:

• Facilitate illegal activities or transactions;
• Host or distribute malware, spyware, or other malicious software;
• Engage in unauthorized data collection, surveillance, or tracking;
• Violate any applicable laws, regulations, or third-party rights;
• Host content that promotes violence, hatred, discrimination, or harassment; or
• Fall within any restricted business category as defined by Stripe (see https://stripe.com/restricted-businesses).

Prohibited activity

Copyright infringement and access to unauthorized material

Our Products must not be used to transmit, distribute or store any material in violation of any applicable law. This includes but isn't limited to:

1. any material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and
2. any material that is obscene, defamatory, constitutes an illegal threat or violates export control laws.

The customer is solely responsible for all material they input, upload, disseminate, transmit, create or publish through or on our Products, and for obtaining legal permission to use any works included in such material. This responsibility extends to AI-generated content: the customer is responsible for ensuring that AI Outputs do not infringe any third-party intellectual property rights before deploying, distributing, or publishing such outputs.

Restricted Businesses and Products

You may not use our Products, including payment processing services, for any business, product, or activity that is restricted or prohibited by Stripe. A list of restricted businesses and products is available at https://stripe.com/restricted-businesses. Engaging in such activities may result in immediate suspension or termination of your account and services.

Unethical, exploitative, and malicious activity

Our Products must not be used for the purpose of advertising, transmitting or otherwise making available any software, program, product or service designed to violate this acceptable use policy, or the acceptable use policy of other service providers. This includes but isn't limited to facilitating the means to send spam and the initiation of network sniffing, pinging, packet spoofing, flooding, mail-bombing and denial-of-service attacks.

Our Products must not be used to access any account or electronic resource where the group or individual attempting to gain access does not own or is not authorized to access the resource (e.g. "hacking", "cracking", "phreaking", etc.).

Our Products must not be used for the purpose of intentionally or recklessly introducing viruses or malicious code into our Products and systems.

Our Products must not be used for purposely engaging in activities designed to harass another group or individual. Our definition of harassment includes but is not limited to denial-of-service attacks, hate-speech, advocacy of racial or ethnic intolerance, and any activity intended to threaten, abuse, infringe upon the rights of or discriminate against any group or individual.

Other activities considered unethical, exploitative and malicious include:

1. Obtaining (or attempting to obtain) services from us with the intent to avoid payment;
2. Using our facilities to obtain (or attempt to obtain) services from another provider with the intent to avoid payment;
3. The unauthorized access, alteration or destruction (or any attempt thereof) of any information about our customers or end-users, by any means or device;
4. Using our facilities to interfere with the use of our facilities and network by other customers or authorized individuals;
5. Publishing or transmitting any content of links that incite violence, depict a violent act, depict child pornography or threaten anyone's health and safety;
6. Any act or omission in violation of consumer protection laws and regulations;
7. Any violation of a person's privacy;
8. Using AI agents or automated systems to circumvent security measures, rate limits, or access controls on the Platform or any third-party service;
9. Deploying AI agents or applications that collect, process, or store personally identifiable information of minors without compliance with COPPA and applicable state laws; and
10. Using AI features to generate content or code that is intentionally designed to exploit, harm, or defraud End-Users or third parties.

Our Products may not be used by any person or entity, which is involved with or suspected of involvement in activities or causes relating to illegal gambling; terrorism; narcotics trafficking; arms trafficking or the proliferation, development, design, manufacture, production, stockpiling, or use of nuclear, chemical or biological weapons, weapons of mass destruction, or missiles; in each case including any affiliation with others whatsoever who support the above such activities or causes.

Unauthorized use of serveyou.ai LLC property

We prohibit the impersonation of serveyou.ai LLC, the representation of a significant business relationship with serveyou.ai LLC, or ownership of any serveyou.ai LLC property (including our Products and brand) for the purpose of fraudulently gaining service, custom, patronage or user trust.

About this policy

This policy outlines a non-exclusive list of activities and intent we deem unacceptable and incompatible with our brand.

We reserve the right to modify this policy at any time by publishing the revised version on our website. The revised version will be effective from the earlier of:

• the date the customer uses our Products after we publish the revised version on our website; or
• 30 days after we publish the revised version on our website.
